Facebook post sparks probe into jury conduct in sex crime trial l MWhitbourn

on March 29 after lawyers for the defendant – who was convicted in December 2016 of sexual intercourse taking advantage of a person's cognitive impairment – applied for an order that the Sheriff investigate potential juror misconduct.

Justice Garling said an "apparently reliable witness" had observed that witness and a juror "socialising and drinking ... at a licensed club in Broken Hill". The District Court sat in Broken Hill for the trial. Justice Garling said there was "evidence, and common knowledge suggests, that Broken Hill is '… a small town and almost everybody knows everybody else'".
