The appeals court judges said the number of children affected were relatively small and a jury would be better fit to evaluate the state’s actions.

The 5th Circuit Court of Appeals ruled this week that state child welfare officials don't have to begin paying massive fines for failing to investigate abuse and neglect allegations in a timely manner. A three-judge panel made clear that its order does not absolve the state of its responsibility to ensure timely and thorough foster care investigations. Instead, it pauses the $100,000 daily fines from a federal judge while the court considers the merits of the state’s argument against them.

Texas fined $100k a day by federal judge for failing to promptly investigate foster care abuse U.S. District Judge Janis Jack, who presides over a 13-year-old case alleging mistreatment of foster children in the state’s permanent custody, ordered the state last month to pay the daily fine. She said state officials had not done enough to comply with remedial orders her court had put in place to improve the quality and outcome of abuse investigations.
