The US Secretary of State, Antony Blinken, said on Wednesday that the Biden administration would work with Congress on an “appropriate response” to the planned charges against Israel’s Ken Roth, founder of Human Rights Watch and international law specialist, believes the court could take action against US officials if they pursue sanctions.“It is an open question what type of retaliation or threat would lead Khan to charge officials. He probably would not move against empty talk, but I suspect that if any official implemented something like travel and financial sanctions… he would not receive that lying down.
“This would be up to the Dutch authorities to determine whether such an ‘effects’ based offence existed and, if so, whether they wished to pursue the US for it,” he said, but added this could face political as well as legal barriers.“Khan could also request arrest warrants for nationals of those states,” said Professor Henderson.
