New Jersey's Supreme Court expanded #MeToo protections for whistleblowers.

A female New Jersey police sergeant should not face legal sanctions for publicly criticizing her former department as a “good ol’ boy” club after settling a discrimination suit, the state’s highest court ruled Tuesday.marked another decision from the New Jersey Supreme Court broadening the rights of whistleblowers, particularly women who speak out about workplace discrimination.

Savage sued again in 2016, claiming the discrimination and retaliation had only gotten worse since her first suit. That case led to another settlement in 2020, which included a provision known as a non-disparagement clause. The day before the Neptune decision, the court struck down confidentiality rules that barred a state worker from talking to others about aIn Savage’s case, the non-disparagement clause used common legal language prohibiting both sides from making any statements “regarding the past behavior of the parties” which would “tend to disparage or impugn the reputation of any party.”
