Former senior officials have backed civil service union plans to challenge the legality of enforcing Rwanda plans

A legal challenge against the controversial Rwanda plan has been backed by senior ex-officials who have warned that laws allowing ministers to ignore international law leave civil servants open to legal action and ethical questions.

Ministers are expected to fight the action, which could further delay Rishi Sunak’s beleaguered Rwanda policy, in the courts.understands the Government is likely to argue that civil servants would be acting in accordance with the code if they carry out policies ignoring the ECtHR, including an obligation not to frustrate the implementation of policies once decisions are taken.

“Because there is a gap left in the Rwanda legislation, it doesn’t crystallise the tension between international law and domestic law and is silent on what compliance with the law in the Civil Service code actually means.” “The Government has chosen not to do that I guess because it would be embarrassing to give an explicit instruction to depart from international law,” he said.
