The administration issued its initial response to lawsuits challenging the president’s declaration of a national emergency.

By Fred Barbash Fred Barbash Law, constitution and courts Email Bio Follow April 5 at 5:50 PM The Trump administration is arguing that the president’s national emergency declaration for the purpose of building a border wall cannot be reviewed by the courts and is not subject to any limitations.

The House suit focused largely on the shifting of funds from military and drug interdiction programs to help pay for the wall, arguing that neither diversion could be justified legally or constitutionally, Trump’s declaration of an emergency notwithstanding. [Trump backs off threat to close border, says he’ll give Mexico ‘one-year warning’ on drugs, migrants]

Responding to arguments that an emergency requires some unanticipated crisis — a natural disaster, for example — the Justice Department noted that other presidents have declared emergencies for a variety of long-term problems. It cited examples including President George H.W. Bush’s declaration of an emergency in 1990 to address the proliferation of nuclear and chemical weapons.

Those who for open borders gain from open borders in terms of power. However doing nothing about it are like ignorant people who refuse to take care of their children's medical needs. Criminal.

Waiting for the people who said, 'Give Barr a chance!' to chime in...

Well guess what. Not happening.

according to the Constitution they do. 'all laws and equity'

The “Justice” Department

This SOB is absolutely nuts! He seems intent on turning this nation into a dictatorship.

Surely the department is familiar with the Constitution and that the Congress and not the president has solely the power of purse?

I'm sure trying to subvert 2/3 branches of government is going to go well for them.

They shouldn't. He's the President, and he's the only one looking out for America.

Build the WALL...

That separation of powers thing really bothers this adminstration. And the GOP wants a king. This must stop.

Of the 20 nations w/the highest homicide rates, 17 are in Latin America. It has only 8% of global population but a third of the world's murders Open border fuels Cartel business Drugs HumanTrafficking Guns YET, Democrats STILL want it wide-open Fridays

Guess how many ppl were killed by white supremacists in 2017? It was 18 Guess of illegal aliens arrested for murder in 2017? It was 1,886 2,028 in 2018 How bad does border have to be for Democrats to admit it's an emergency?

No More Room Declare all illegal Aliens Enemy combatants LOCK Them UP in tent cities until they agree to go home

Red they do!

Barr was selected to protect the president, that's why he is not supporting the ACA law, the President can't be accountable for crimes, he will soon defend the President in his census question, and the election is fraudlent. He has Kavenaugh and Gorsch to support him.

Our Declaration of Independence (What we said about the King of England and why we went to war): He is “obstructing the Laws for Naturalization of Foreigners; refusing to pass others to encourage their migrations hither.” America’s founders would not be pleased with Trump.

A cheaper alternative to the wall!

Courts have a say in everything in the U.S... He is not a dictator. Yet.

Yep Trump is going to go and watch the WORKING POOR , Build his wall .

Did we get a new Constitution?

Good

Ahhh...isn’t that the job for Congress

Absolutely!

The corrupt Attorney General. How can anyone take anything coming out of this justice department seriously when the AG is as corrupt as Idi Amin.

Exactly..the last thing the administration wants ..is to have to argue the case on its merits.. Thanks for the write up....👍

So when a Dem president says the courts can't review a climate change emergency action, or a gun control thing, conservatives will be more than happy to agree, right?

And how pathetic does he look, stood in front of that lump of concrete, Nazism personified.

So you know that whole 'no oversight because you don't question a monarch' thing? Americans fought a revolution over the idea? Yeah? The DoJ is kinda 'Oh, never mind.'

LOL I’m a lawyer. That’s one of the worst arguments I’ve ever heard

Are the employees of TheJusticeDept wearing MAGA hats to work now?

Sure

We are not living in a dictatorship yet

Trump administration: Our government doesn’t recognize checks and balances.

Pretty sure the courts will beg to differ.

Don't bankrupt America like your other businesses. We don't need no stinking wall. ResignTrump

That is hilarious. Article I was just for kicks and grins?

Oh, it’s that “courts aren’t allowed to rule against the Supreme Dictator” thing.

Hooray for the rule of law.

Surely the ‘new’ legal team knew this already 😂

Yeah theh do

Ceci n'est pas une WALL c'est une FUCKEN FENCE

Sure sure

Will it even happen by the next election though?

Congress Gave the executive branch these powers back in the 70's...

Justice Department argues the Judicial has no role in interpreting the Constitution.

Lol. I’m sure the courts have something to say about that

Lets just put a wall around him and get our country back
