While federal investigators were exploring the National Enquirer’s relationship with Donald Trump during the 2016 campaign, David Pecker, the Enquirer’s publisher, was trying to sell the publication and two others owned by American Media Inc. Defense attorney Emil Bove asked repeatedly whether Pecker signed a non-prosecution agreement in September 2018 to eliminate the specter of the investigation hanging over AMI, and thereby pave the way for a sale to Hudson News.
“You knew to finalize that deal,” Bove asked, “you had to clear up the investigations?” Pecker paused for a moment, then said, “Yes.” “That was ultimately written into the deal papers,” Bove said, “the investigations had to be resolved before the $100 million could be taken out of escrow?” Yes, Pecker said. “It created a little price pressure on the negotiations?” Bove said.
