The families of three men who died while waiting on liver transplants are seeking a restraining order to prevent the surgeon from destroying evidence.

Bynon previously presided over the liver transplant program at Memorial Hermann, which was recently put on pause due to “irregularities.”

The TRO would prevent Bynon from deleting or destroying critical evidence that could help show if the families’ loved ones were improperly denied transplants. Attorney Tom Hastings said the exact language was still being decided but he believed both sides agreed on the “principle of the matter.”
