The Texas Education Agency is expanding its accommodations for testing applicants after reaching a settlement with the U.S. Department of Justice over a violation of the Americans with Disabilities Act.

"The goal is to make sure that we're eliminating anything that creates an uneven playing field," East said. "Testing accommodations are very common issues, very commonly sought very commonly granted, and also the basis of a lot of ADA complaints and lawsuits." The agencies reached a settlement last week after the D.O.J. sued the T.E.A. over an alleged Americans with Disabilities Act violation. Assistant U.S. Attorney David Goode says in 2022, they received a complaint that an individual with dyslexia and dysgraphia was denied alternative testing accommodations during a teacher certification exam.

Under the settlement, the TEA will now allow a qualified reader or the use of text-to-speech technology as alternatives for testing candidates who are able to provide documentation for their disability. This includes the person who initially made the complaint.
