Benjamin Cervera died of starvation by homicide, and his stepmother is on trial for his death. The child's father is also charged with injury to a child causing serious bodily injury by omission.

Benjamin Cervera died of starvation by homicide, Bexar County Chief Medical Examiner Dr. Kimberley Molina told jurors who will decide whether the child’s stepmother will be convicted in his death. Miranda Casarez, 25, is charged along with Benjamin’s father, Brandon Lee Cervera, 30, with injury to a child causing serious bodily injury by omission.

Cantrell pointed to at least four earlier doctor visits that did not indicate Benji was being starved, and he pointed out that some of the doctor’s reports had information that Casarez provided of the child not eating, throwing temper tantrums and self-harming. Defense attorneys asked why doctors would not have had him hospitalized if he was being deprived of food.
