WASHINGTON - The U.S. Constitution does not guarantee a prisoner sentenced to capital punishment “a painless death,” a divided Supreme Court said on Monday, paving the way for the execution of a convicted murderer who sought to die by lethal gas rather than lethal injection because of a rare medical condition.
In a decision that exposed stark divisions among the justices on the death penalty, the court ruled 5-4 that Bucklew had failed to present enough evidence to pursue his request to be executed by lethal gas. The court’s five conservatives were in the majority and its four liberals dissented. Bucklew failed to show that lethal gas could be “readily implemented” as required under Supreme Court precedent, the court ruled. There also was no evidence that his chosen alternative, lethal gas, would be less painful, it concluded.
Fellow conservative Justice Samuel Alito said in 2015 that the legal challenge to Oklahoma’s method of execution case was part of a “guerilla war” against the death penalty. When death row inmates seek last-minute stays of execution, courts should individual cases on their merits, Sotomayor said. In Missouri, execution is authorized using either injection or gas but the state in practice uses only lethal injection.
Who said that they were entitled to a painless death? Maybe so if they killed their victims with kinder gentler hands.

Nope, the measuring rod is 'Cruel and unusual.' The Constitution does not specifically prohibit 'Painful.'

Acho a pena de morte um erro grave. Posto isto, analisando a decisão, que não combateu a pena de morte em si, mas o meio pela qual seria aplicada, a decisão foi bem fundamentada. Concorde ou não com a suprema corte eles decidem apenas com fundamento na constituição.

Why not? Offering grace should be the example set rather than behaving like one who is being executed. Perhaps he's change. Even still, why mimic behavior after we've condemned that behavior? Forgive us of our trespasses as we FORGIVE those who trespass against us.

Were these convicted murders thinking of a 'painless execution' for their victims when they bludgeoned, knifed, strangled and shot them to death? Perhaps they'll feel better if the executioner gives them a written guarantee!

I'm against capital punishment, but I have to put forward the guillotine solution due to recent horror stores with the chemicals: Low cost, reusable, quick guaranteed result.
Did they give their victims painless deaths? No. We should go back to hanging them, rope is cheaper and re-usable. Exhausted your appeals? Time to swing.
