Zuma has been disqualified from standing as a candidate in the upcoming 29 May elections because of this section of the Constitution.Earlier this month, the commission upheld an objection to Zuma’s candidacy and disqualified him from standing for legislative seats in upcoming general elections. “That sentence would then read like this, the total sentence the applicant was to serve was 15 months, if the 12-months remission was deducted from this sentence, it will leave a sentence of three months,” said Adv Dali Mpofu SC who represented Zuma.
Zuma only served three months before receiving presidential remission, and his lawyer, Advocate Dali Mpofu, argued that Section 27 does not apply to him.The Constitutional Court found Zuma guilty of contempt of court in 2021 and sentenced him to 15 months after he refused to appear before the Zondo Commission of Inquiry into State Capture.
