Bruce Lehrmann’s high-profile defamation trial will resume in Sydney’s Federal Court after Network 10 won its eleventh-hour bid to reopen its case amid fresh evidence.

In an urgent hearing on Tuesday night, Network 10 was granted leave to introduce its new evidence which included some 2,300 pages worth of sworn affidavits from Mr Auerbach. The court heard the material allegedly included private text messages between Brittany Higgins and her then- boyfriend Ben Dillaway.Dr Collins submitted if Mr Lehrmann was the alleged source of the material it was an"outrageous contempt of court" and against an implied undertaking that the information not be used outside court proceedings.

"This stuff is trivial and it’s just not relevant, and to give in my respectful submission leave to reopen on that sort of material, Your Honour, would be inappropriate," he told the court on Tuesday.Mr Auerbach arrived back in Australia on Tuesday night from New Zealand ahead of his court appearance on Thursday.
