Queensland juries are struggling to deal with complicated and confusing consent laws in rape cases and vulnerable women are suffering, prompting calls for law reform.

A jury's query about whether a Hong Kong nanny telling her accused rapist"I don't want" meant"no" under Queensland's sexual consent laws shows the need for reform, women's advocates say.

The woman, who spoke"poor English", accepted under cross-examination she had initially kissed him back, but was emphatic that she repeatedly pleaded"I don't want" and cried when he allegedly raped her. "[With mistaken belief …] the big thing is there is no burden on him to prove that he was acting under an honest and reasonable ground. It is for the prosecution to … prove he was not," she said.

'I don't want' can be construed to mean *not now* but maybe can be talked into it. No simply means NO not at all.

I wouldn't have got a clear 'yes' out of 'I don't want'. Therefore one would have to assume it's a clear 'no'. Were the jurors sleeping on the case?

This is the easiest question to answer you simply ask and only if there is a yes have you got consent. if there is going to be any further discussion on the issue it has to be debated by a group of women only, no men have the right to decide even though it is clear to me as a man

Yes

Mistaken belief?! What nonsense! How does a rational, reasonable person get “yes, go for it” from “I don’t want”?!

In time all men will be accused, the continual changing and skewing of consent laws is weaponising them. Understand women’s hypergamic natures men, know what drives them, dig deep.

I’m surprised the question is even being asked...

Where on the Gold Coast is the forum being held?

Definitely needs changing.

NZ PM Jacinda Ardern shows America how gun reform is doneIn the end it takes just two things: A leader with compassion and vision, and a community prepared to care more about the common good than individual rights. jacindaardern Forget America!! It shouldn’t be that hard is Australia!!! jacindaardern New Zealand has about 5 million people. America over 300 million. This is a ludicrous statement. Americans have a bible in one hand and a gun in the other. They have the second amendment and a frontier mentality. DREAM ON! jacindaardern 1 There’s a constitutional difference for one. 2 It’s wrong to punish the innocent for the acts of the wicked. 3 People who break the law don’t care greatly what the law says. 4 This is a theoretical victory, you don’t know how many guns there are or where they are anymore.

Call for tougher trespass laws after dozens of animal rights activists invade feedlotThe Federal Agriculture Minister calls for tougher penalties to target animal rights activists trespassing on farms, after more than 100 people entered a property over the weekend. Give cows guns ?. Just toughen up the welfare laws - maybe they could all get a job or offer assistance to the farmer. Or we recognise that established farming methods do involve some level of animal cruelty, not limited to slaughter, mutilation for breeding purposes and exposure to disease/starvation and stress. It's a process marred by violence, one must admit, even if it appears necessary.

'It felt like a violation of my rights': the issue of consent during childbirthDoctors used forceps to deliver Amy Dawes' baby despite her 'begging' for more time to push. Now, she's founded an association to educate expecting mothers about their rights and choices. If there's any research being done on women who had unnecessary procedures done without consent during labour, I'm over here. It was minor, and I understand the cock-up that led to it - but it happened. Someone with 8 years of training and X year of experience your feelings. Welcome to the current year. Yeah, keep it up and Doctors won’t bother anymore. Get ready for lots of birth defects and still borns if you keep going. Future news: Baby born with deformed head “why didn’t the Doctor do anything? That’s your job!” I wanted a natural birth etc etc blah blahhh

'It felt like a violation of my rights': the issue of consent during childbirthThere is a fine line between necessary medical interventions to ensure the safety of both woman and her baby, and decisions made that violate a woman’s rights. schetzer Important topic, but why is it placed in the 'Life and relationships' section of the website, and not 'Healthcare'? Seems ironic that the content of the article is about women wanting medical issues to be taken seriously + yet it's 'trivialised' into a more 'lightweight' section. schetzer Quite a misleading article at times.. e.g. junior doctors never make such important decisions as who needs a C-section.. doctors do not carry out medical procedures in childbirth unless necessary, in this case, to prevent disastrous outcomes for the baby
