Halifax police investigating Monday morning Dartmouth death as suspicious | SaltWire #newsupdateOTTAWA – As the prime minister attempts to quash an order demanding he start quickly filling dozens of judicial vacancies, the human rights lawyer who first brought the issue before the courts is fighting back in court, countering that the government should be forced to act within nine months.

The cross-appeal at the FCA is the latest twist in a nine-month long legal saga which began when Hameed filed a lawsuit in the Federal Court to mandate the government to fill the then nearly 80 vacant judge spots in short order. Brown’s ruling quoted abundantly from the letter sent by Supreme Court of Canada Chief Justice Richard Wagner to Trudeau last year in which he denounced the government’s “inability” to fill vacant judge positions in a “timely manner”.

Two weeks ago, Trudeau and Virani appealed the Federal Court ruling, arguing that it vastly exceeded the court’s jurisdiction all the while creating a new unwritten “judge-made” rule that was being used to “compel” cabinet to appoint judges.
