Company at centre of listeriosis scare is taking legal action over shutdown order, claims elderly woman should not have been given sandwiches as she's over 70.

A catering company at the centre of a listeriosis scare is taking legal action to overturn a state government-imposed shutdown order it claims was made "without any justification whatsoever".

The health department closed I Cook Foods of Dandenong South last month after meals it provided to a private hospital in Melbourne's east were suspected to have been contaminated with listeriosis and contributed to the death of an 80-year-old woman.The company's lawyer, David Brett, said action was being launched in Melbourne Magistrates Court to overturn the order, which he said was made prematurely and unjustly.

Following the closure in February, Victoria's chief health officer Brett Sutton said he acted out of an "abundance of caution" to close the kitchen, while the department investigated the woman's death.
