The Albanese government is bracing for a fresh wave of High Court cases – and rulings – against the powers to hold people in immigration detention indefinitely.

The ruling meant 148 other detainees, many of them criminals convicted of serious crimes including murder and sex offences, were freed because there was no real prospect they would be deported in the reasonably foreseeable future. “I’ve never seen anything like this in terms of an effort to reduce as far as we humanly can the risk to the community presented by 149 people,” he said.but in an illustration of the workload involved to build a water-tight cases, about 35,000 documents are being assessed for just one individual.

The case will determine whether ongoing detention is justified when people have refused to co-operate with attempts to deport them, and could affect dozens of detainees.
