Countries including Brazil and Chile urge appeals court to overturn record award over expropriation of oil group

Brazil, Chile and other large South American economies have called for a US appeals court to overturn a record $16bn judgment against Argentina, which was found last year to have violated shareholders’ rights when it expropriated national oil company YPF. The ruling by a New York judge has become a problem for Argentine president Javier Milei’s new administration.

In its own brief to the Supreme Court over a pre-trial challenge to the case in 2019, the US government — then led by Donald Trump — wrote that the country had “a countervailing interest in ensuring that foreign states that enter US markets as commercial actors do not enjoy immunity from lawsuits regarding violations of their commercial obligations”. It further pointed to the fact that YPF’s shares had been sold on the New York Stock Exchange.
