State Sen. Brian Birdwell says Texas immigration legislation would usurp both Congress and the federal government.

A Republican lawmaker spoke out late Thursday against his party’s sweeping proposal for the state to remove people from the country who are suspected of crossing the border illegally, an extraordinary rebuke amid the GOP majority’s unwavering support for Texas’ escalating immigration crackdown. The rare statement of defiance from state Sen. Brian Birdwell came around 10 p.m.

” He said in addition to violating the 10th Amendment, the latest draft also violates constitutional provisions that give Congress power over immigration laws. “That clause specifies all power and responsibilities for immigration is delegated to the federal government,” Birdwell said in his Thursday floor speech.
