Garry Taylor Handlen, who was convicted of murdering 12-year-old Monica Jack, has filed an appeal seeking to have the conviction quashed and a new trial ordered.

The man who was found guilty in the slaying of a 12-year-old girl more than 40 years ago is appealing his murder conviction.

Lawyers for Handlen have now filed a notice of appeal at the B.C. Court of Appeal seeking to have the court quash the conviction and order a new trial. Handlen is claiming that the trial judge erred in admitting into evidence statements made by him to undercover RCMP officers who were posing as members of a criminal organization.

The judge also allowed four statements from witnesses that dealt with what they had observed in connection with the apparent abduction of Monica at a pullout of what was then Highway 5 north of Merritt, along the east shore of Nicola Lake. Each witness was subject to hypnosis after giving their initial statements to police in an attempt to enhance their memories and provide more detailed descriptions of what they had seen.
