N.S. flood victim surprised by apartment makeover | SaltWire - The Supreme Court of Alabama has authorized state officials to proceed with what would be the first execution of a prisoner in the U.S. using asphyxiation by nitrogen gas.
Smith's lawyers have said the untested gassing protocol may violate the U.S. Constitution's ban on"cruel and unusual punishments," and have argued a second attempt to execute him by any method is unconstitutional. They also told the court that Smith had not yet exhausted his appeals. Smith was one of two men convicted in the 1988 murder-for-hire slaying of Elizabeth Sennett in Alabama's Colbert County.
Oklahoma and Mississippi have also approved nitrogen asphyxiation executions, but have yet to try the method.
