After hearing from Veal outside the presence of the jury, Judge Bryan Chushoff ruled that Veal could testify about the impacts to Ellis' pulmonary system but could not comment on his cause of death. Much of the conversation was dominated by discussion of at what point Ellis became hypoxic - which is cited in the medical examiner's ruling on his cause of death - along with when Ellis was placed into the recovery position and for how long he remained there.

Burbank and Collins are charged with second-degree murder and first-degree manslaughter. Rankine is charged with first-degree manslaughter. On March 3, 2020, Ellis was walking home when he stopped to speak with Tacoma Police Officers Burbank and Collins, who were in their patrol car, according toWitnesses said Ellis turned to walk away, but the officers got out of their car and knocked Ellis to his knees. All witnesses told investigators they did not see Ellis strike the officers.
