Judge Lewis Kaplan ruled against the defense’s attempted use of author Michael Lewis’ book “Going Infinite” in court, according to a transcript of FTX founder Sam Bankman-Fried’s trial on Monday. The back-and-forth wasn’t heard in court because it was a sidebar between the prosecutor, the defense and the judge. Bankman-Fried’s lawyer Mark Cohen had wanted to cite a conversation Bankman-Fried had with FTX’s former director of engineering Nishad Singh from Lewis’ book.
Bankman-Fried was quoted as responding to Singh: “I don't think we did anything wrong. I don't think you did anything wrong.” To which Singh then said: “That's not good enough.” The government prosecutors objected because they considered it a false exculpatory and inadmissible hearsay, meaning that it’s a piece of evidence that tends to excuse, justify, or absolve the alleged fault or guilt of a defendant. The objection was sustained by the judge.
