A recording of an alleged confession by Senzo Meyiwa murder accused Bongani Ntanzi took centre stage at the Gauteng High Court in Pretoria.On Monday, accused 1 Muzikawukhulelwa Sibiya and accused 2 Bongani Ntanzi bolstered their defence by appointing Advocate Thulani Mngomezulu to deal with aspects relating to the confessions they allegedly made.
The court also heard that Ntanzi was calm, relaxed and even made eye contact when he made his confession. Ntanzi previously claimed that he was assaulted by police and was forced to sign the confession statement, however Cronje told the court that Ntanzi was asked if he had any injuries and if he does he should show them.
“His answer was no, except for old injuries he sustained underground and the one he sustained when he was young,” she said.The State previously indicated that it will not use the recording and made a U-turn, however on Friday, Judge Ratha Mokgoatlheng ruled that the recording should not form part of the evidence in the trial.
“Accused 2 would then be continuously subjected to a trial unfairly when we know that the Constitution engages us enjoins us to prevent such an exigency. Also in the view of this court that would bring the administration of justice into disrepute. Consequently this court rules that the audio recording should not form part of these proceedings, it is inadmissible,” he said.
