SYDNEY, N.S. — A Nova Scotia Supreme Court judge has ordered that a Sydney small claims court adjudicator hold an in-person hearing.

The case involved appellants Kalvin George and Barbara Floyd who sold a trailer to David LeBlanc and Debbie LeBlanc. After a phone hearing in April, without George or Floyd participating, Young awarded $7,500 to David and Debbie LeBlanc.“I am of the view that the adjudicator should have exercised his discretion to hear the matter in person. I agree with the appellants that this dispute will obviously require a determination of credibility. This cannot properly occur over the telephone,” ruled Chipman, in his appeal decision.
