The eight-year sentence handed to a Calgary dad who left his daughter in Iraq in violation of a custody order can’t appeal his sentence, the nation’s top court ruled Thursday.
Stirling had handed the Calgary man a 28-month sentence, but a three-member Court of Appeal panel more than tripled that to eight years. “She has not been returned,” Spark said. It’s unknown if the daughter, Zahraa, remains with family in Bagdad. Al Aazawi was convicted by Stirling of abducting the girl in contravention of a custody order in favour of the mother, when he took her to the Middle East in 2018 for a summer holiday for her 11th birthday and detoured the trip from Egypt to his native Iraq.In the appeal decision Justices Anne Kirker and Barb Veldhuis said Al Aazawi’s crime was not diminished by his later efforts to bring her home, something the girl objected to.
