In her explanation for the decision, Judge Torres said the regulator failed to meet its burden to show that there were controlling questions of law or substantial grounds for differences of opinion on the matter. But not everyone agreed with that outlook, including Gabriel Shapiro, general counsel at Delphi Labs, who warned crypto advocates that the SEC can still appeal the decision once the case has been fully tried.

As the case progresses towards its April 23 start date, the parties involved have until Dec. 4 to submit any motions in limine, with oppositions to any such motions due by Dec. 18.
