The Federal Court, comprising nine judges for the first time, will decide if a provision in a drug law that enables the prosecution to get an easy conviction is constitutional.

PUTRAJAYA: The Malaysian judiciary will create history on March 13 when, for the first time, a nine-member apex court bench will deliver its judgment in a criminal appeal.

Malanjum, who was appointed top judge last July, in his maiden speech had said all constitutional cases would be heard by nine judges while a bench of seven would hear public interest cases.Gopal Sri Ram and Srimurugan are representing Philippine national Alma Nudo Atenza and Thai citizen Orathai Prommatat who were sentenced to death for drug trafficking.

The government then introduced Section 37A to allow the prosecution to rely on presumptions under Section 37 and 37 of the DDA, thereby overruling the Federal Court judgment.
