The judge overseeing the fraud trial against former President Donald Trump and his company imposed a gag order Tuesday after the former president made a disparaging post about a court clerk—which legal experts suggest could have a knock-on effect in the other cases against Trump, particularly as he faces a potential second gag order in his federal election case.
The gag order—which could result in sanctions if Trump violates it—is the first to be imposed against Trump in cases against him, though U.S. District Judge Tanya Chutkan is alsowhether to impose a gag order on Trump in a separate federal case charging him based on his efforts to overturn the 2020 election, which would bar Trump from making comments that “present a serious and substantial danger of prejudicing” the jury and the case.
Engoron’s gag order “is actually a bigger deal than it appears because it breaks the dam” when it comes to other judges issuing gag orders on Trump, attorney Paul Rosenwig, former deputy assistant secretary for policy at the Department of Homeland Security, told the, adding you can “bet dollars to donuts that Judge Chutkan … is watching these proceedings and thinking, you know, I’m going to wind up in this mess too, with a defendant who’s mouthing himself off, attacking my clerk, attacking me.
The gag order “might have a domino effect on the other matters,” defense attorney and former federal prosecutor David Weinstein told the Messenger, noting the order “certainly sends a strong message that there is a line between free speech and inciteful speech, which is at the heart of two of the four criminal cases pending against Trump.
