SA already signed OPCAT in September 2006; however, it was yet to ratify the protocol, the SAHRC has said.

The South African Human Rights Commission welcomed the Cabinet decision of February 28, to refer the Optional Protocol to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment to Parliament.

The OPCAT was adopted by the United Nations General Assembly in 2002 and came into force in 2006, the statement read. States are obliged to establish a National Preventive Mechanism to monitor places of deprivation of liberty on an announced or unannounced basis.
