At the time of the sale, the complaint says, Westcott had recently been discharged from the hospital after surgery. While there, he was allegedly “given a variety of medications, including the anesthesia for his surgery and pain-killing opiates.” The complaint, filed Aug. 5, 2020, alleges that because of the “combination of his age, frailty from his back condition and recent surgery, and the opiates he was taking several times a day,” the plaintiff was “of unsound mind” when the transaction took place.ADAM AMENGUAL/NYT, Westcott had closed on the estate less than two months earlier for $11.25 million — which meant he stood to make almost $3.75 million in six weeks on the home.
This quick and lucrative turnaround was addressed in the court documents: “It does not matter to Mr. Westcott that Ms. Perry is willing to pay him $3,750,000 more than Mr. Westcott paid to purchase his home just a few months earlier,” the complaint says.for missed rents from the property, as well as for having to maintain another property while waiting for the matter to be resolved.
