It says the High Court judge erred in law and facts for arbitrarily using his inherent powers to quash the power abuse charges.

The High Court acquitted and discharged Muhyiddin Yassin of four counts of abuse of power linked to the Jana Wibawa programme after finding that the charges were defective.

It said the judge was also wrong to use these powers to prematurely revoke the charges when the prosecution had yet to produce evidence by calling witnesses and tendering documents. It said the judge also did not give the prosecution the opportunity to amend the charges if it failed to state clearly how Muhyiddin used his position as prime minister to commit the offences.

The prosecution also said the judge was wrong to hold that Bersatu does not fall under the category of organisation to include the meaning of associate under Section 3 of the Malaysian Anti-Corruption Commission Act 2009.
