Jurors had to decide if Officer Dustin Dillard used excessive force and violated Tony Timpa’s constitutional rights when he knelt on his back for about 14...

Timpa died after he called 911 from the parking lot of a porn store on Mockingbird Lane and reported he was afraid and unarmed, adding he was off his prescription medication for anxiety and schizophrenia. Body-camera footage shows he was handcuffed behind his back and pinned facedown by officers as he yelled for help. When he became unresponsive, officers joked about waking him up for school. He died within about 20 minutes of the officers’ arrival.

“We are talking about a broken promise associated with 911,” Henley said. “Let the world know that 911 has to mean something.” Dr. Jeffrey Barnard, Dallas County’s chief medical examiner, told the jury that Timpa had “a significant outcome” from a “significant amount of cocaine” in his system. As Barnard watched body-camera footage in front of the jury, he said Timpa began to die under Dillard’s knee. He said the officers’ restraints played a role, but there was no evidence that he died of asphyxia.

Dominguez and Vasquez apologized to Timpa’s family for their jokes about waking him up for school. They testified they thought he was asleep. Dillard told the family he just wanted to get Timpa help and he prays “for Tony and you every single day, and I always will.”his death had an immense impact on their lives
