Thanks to some missing bones, Steven Avery could be headed for a new trial in the Teresa Halbach murder case

Avery was convicted of the 2005 murder of Halbach and is serving a life sentence with no possibility of parole. The Emmy-winning Netflix documentary, released in 2015, followed the murder investigation and judicial process, and in some viewers’ minds, cast doubt on the guilt of Avery and his nephew Brendan Dassey, who was also convicted of the murder and is serving a life sentence; Dassey is eligible for parole in 2048. Both men maintain their innocence.

Zellner brought the current motion based on her discovery that bones that were found in Manitowoc County — but not on Avery’s property — had never been tested for Halbach’s DNA. The Wisconsin Department of Justice had the bones in its possession but gave them to Halbach’s family even though law enforcement claims the bones were never determined to be human or animal.

Zellner believes the bones could be Halbach’s remains, and if so, would obliterate the prosecution’s theory that Avery and Dassey killed and burned Halbach’s body on Avery’s property, on which the state’s murder case rested. Zellner’s argument is based on both
