Justice Mojisola Olatoregun of the Federal High Court in Lagos has ordered for oral evidence in a suit filed by the Economic and Financial Crimes Commission seeking an order to forfeit the sum of N9.2billion and $8.3million linked to Patience Jonathan.

"I hold that this suit was filed under section 17 of the Advanced Free Fraud and Related Offences Act, which an action in realm thereby cannot constitute and abuse,” the Judge ruled.Justice Olatoregun had, in May 2018, granted temporary forfeiture of N9.2billion and $8.4million linked to the embattled former First lady. The judge made the order on the application filed and argued by Rotimi Oyedepo, counsel to EFCC, on April 20, 2018.

The funds, he said, were moved when the former first lady served as a permanent secretary in one of the ministries in the state. “In depositing the funds into the account of the 1st respondent, the said domestic staff, in a bid to conceal their identity, deposited the funds, reasonably suspected to be proceeds of unlawful act, into the 1st respondent’s account, using fictitious names.

“The funds sought to be forfeited to the Federal Government of Nigeria are not the 1st respondent’s lawful earnings but are rather reasonably suspected to be proceeds of unlawful activities.” “The depositors into this account are domestic staff of State House, Abuja, procured by the said Dudafa Waripamo-Owei, to deposit the funds sought to be forfeited in a bid to conceal the true origin of the funds,” Tukura said.
