Eric Miller's confirmation to the 9th Circuit Court is the first time the White House wholly ignored input of home-state senators.

Eric D. Miller, nominated to be U.S. circuit judge for the Ninth Circuit, attends a judicial nomination hearing held by the Senate Judiciary Committee, Oct. 24, 2018 in Washington, D.C.

Miller was confirmed on Tuesday on a 53-46 vote, allowing Trump to continue to move toward a more conservative federal judiciary, one of his key campaign promises.Historically, senators from the state where a federal judiciary nominee lives may submit opinions, known as “blue slips,” or choose not to return them.

In July, Oregonian Ryan Bound’s nomination to the 9th Circuit proved equally controversial. Neither of his home-state senators, Ron Wyden and Jeff Merkley, both Democrats, returned a slip in support of the Oregon assistant United States attorney. Under President Barack Obama, Republicans used the blue slip prerogative to veto nominees. But a Republican-controlled Senate and changes in congressional rules, which now allow a simple majority for confirmation of judges instead of the 60 votes required earlier, have enabled Trump to push through nominees.

Isn't it kind of a silly precedent anyway? Not endorsing the judge, but if say, there was a qualified left-of-center judge from Kansas and the Dems controlled the Senate, why should we let two Republican Senators deny that judge from being appointed?

Dems have to realize they are at war with GOP

I say this is the pot calling kettle. Pity you can’t post an article that we can actually read. Your attempt at objective journalism is a farce, an illusion. We don’t trust you!

FakeNews no, it's common sense

Gotta rush and get 45's person in the 9th district...Before he and family are indicted... 45, with the help of the GOP has planted judges everywhere they believe 45 will be judged... Supreme Court; Attorney general; 9th district Hoping to escape prosecution... NotAboveTheLaw

Most appointees haven’t been vetted by the Bar Association either‼️

The sky is always falling for libs. Lol!!

Mtneedle And for all the George Conway fans..this appointment? This judge? These are what George thinks trump is doing right. He likes the conservative judges. He doesn’t like how he’s doing it , because it exposes the Republican m.o. , but he likes the agenda.

The 9th circuit is a joke. It’s the most overturned court in the US. Whacko leftists have been stacking it with activists for decades.

Few more needed

About time Americans have someone working for them and NOT the Democratic Party.

Consent?

What goes around comes around. When Dems take over Senate in 2020, the same will happen to GOP.

Winning

Another not good move.

So WaPoImbeciles disagree with apparently turn-coated centrist Chief Justice John 'Souter' Roberts that Judges & Justices are nothing but political appointees. Typical imbeciles that have no journalistic neutrality.

And they are silent yet again

Abuse of power: In the form of 'malfeasance in office' or 'official misconduct,' is the commission of an unlawful act, done in an official capacity, which affects the performance of official duties... senatemajldr

If there isn't 'must' language, then it's merely a 'nice to have'. 🤷🏼‍♀️

And this is surprising how?

He doesn't need their consent.

No you just uninstall.

Trump trying to stack the 9th Circuit the same way as the Supreme Court.

No- the vestigial use of blue slips is the problem. They should go the way of spittoons on the floor.

Oh please with the pearl clutching. MSM proclaims catastrophe when libs don't get their way. Yawnsville.

Stop tweeting articles that you won’t let me read.

Without consent? Lol... That's funny. There doesn't have to be any consent.
