The nine-member commission alleged that Rokita broke confidentiality rules when discussing obstetrician-gynecologist Caitlin Bernard during a July 13, 2022 appearance on a Fox News show hosted by Jesse Watters.Earlier that month, Bernard had been quoted in an Indianapolis Star article which discussed her providing an abortion for a 10-year-old Ohio rape victim who was, at the time, six weeks pregnant.
Rokita’s comments, the commission members wrote in their complaint, constituted a violation of Indiana’s Rules of Professional Conduct, which prohibit the disclosure of a pending investigation. The commission further claimed that Rokita’s characterization of Bernard violated a professional rule barring attorneys from making statements “that have no substantial purpose other than to embarrass, delay, or burden a third person.
