Lawyers for Wilson's Hospital School in Co Westmeath asked the High Court to take the 'radical step' of jailing Mr Burke

On each occasion Mr Burke, accompanied in court by members of his family including his parents Martina and Sean, remained silent.

Mr Justice Heslin was interrupted on several occasions by members of the Burke family. Gardaí were asked to intervene and had to physically remove Mr Sean Burke and Enoch’s brother Isaac Burke from the courtroom. Representing himself Mr Burke opposed the application and argued that it was in breach of his constitutional rights to religious freedom and expression.

Opening the application Mr White said that the application. which had been brought with great reluctance, but that the school had no option other than seek Mr Burkes committal. He said that at all times “I have conducted myself in a clam measured, reasonable and respectful manner in my conduct at the school. and my interaction with others at the school.”He claims parents and student have shaken his hand and last May before the end of the school year. half the Leaving Cert class of 2023 were £begging me to sign their school shirts and blouses” as well as asking for autographs and posing for pictures.
