“To be clear, the most appropriate time for any testimony on these subjects is after the matter is closed, especially under the circumstances where the matter is pending before a court and subject to judicial supervision, not to mention legal and ethical bars that limit what the Department can say while the matter is pending in court,” said a letter the Justice Department released last month.
“These deviations took place while Mr. Weiss, with the full support and backing of the Department, oversaw the Hunter Biden investigation as U.S. Attorney—prior to receiving special counsel status,” their letter continued. It also said that appointing Weiss special counsel suggests that past statements made by Garland and Weiss about Weiss’ authority to bring charges “were misleading and/or untruthful.” It noted that Garland told the Senate Judiciary Committee in March that Weiss had “full authority” to bring cases in jurisdictions apart from Delaware, if it was necessary.
It also noted news reports that indicate Weiss had “a close and personal relationship with Mr. Biden’s deceased brother, Beau, further undermining his impartiality.” Weiss was appointed as Delaware’s U.S. Attorney by former President Donald Trump and began the Hunter Biden probe while Trump was president.
