Afriforum says the NPA's decision appears to be irrational and wrong in law. Should they privately prosecute Mbalula?

Fikile Mbalula, was cleared by the NPA of any wrong doing after his sponsored family holiday in Dubai in 2016Afrikaner lobby group Afriforum says it's convinced that ANC secretary-general Fikile Mbalula has a case to answer and was weighing its options, despite the decision by the state not to prosecute him.

At the time the company, whose director is Yusuf Docrat, had a contract with the SA Sports Confederation and Olympic Committee.The private prosecution unit is pleased the NPA finally took a decision in the matter against former sports minister, Fikile Mbalula. The decision, however, appears to be irrational and wrong in law. Nevertheless, this point would never have been reached without the constant pressure the unit has applied on the NPA to simply perform its duty.

He said the NPA appeared to have uncritically accepted the version provided by Mbalula that the money was not a gift. The definition of a gratification in the Prevention and Combatting of Corrupt Activities Act is the following: any donation, gift, loan, fee, reward, valuable security, property or interest in property of any description, whether movable or immovable, or any other similar advantage.
