Speaking to Belfast Live, the injured man's husband says he feels they have been 'denied justice'

A man has expressed his frustration with the PPS after it has refused to charge a man following an incident that left his husband severely brain damaged.

It also said that it believed it could not convince a jury that the man was not "acting to defend property; or not acting to prevent a crime or to apprehend an offender; or if he was so acting, the force used was excessive." "I feel that by the PPS refusing to even charge this man for his actions, which have destroyed my husband's life and left him severely brain damaged, is denying us our chance at justice because all we want is for the matter to go to court so that a jury is able to give their verdict, whatever it may end up being.

"I feel really let down by how the PPS and police have handled this but it will not stop me from continuing to fight for justice for my husband." It is understood that the senior prosecutor working on the case, having taken advice from independent counsel that the test for prosecution was not met.A PPS spokeswoman said: “The PPS received a file in connection with a police investigation into an incident in south Belfast on 28th May 2022 during which a man suffered serious injuries.

It is our duty to put before the court only those offences which meet the Test for Prosecution; namely that provide a reasonable prospect of conviction and where prosecution is in the public interest. In this case, it was concluded that the available evidence was insufficient to meet this Test.
