The judge presiding over the Pete Mihalik murder trial has found that the person in the CCTV footage of the shooting is accused number one, Sizwe Biyela.

"Lies" and"outlandish" explanations were the words Western Cape High Court Judge Constance Nziweni used on Wednesday to describe the testimony of the alleged triggerman in the Pete Mihalik hit. She found that credible police facial recognition analysis found only one dissimilarity between a picture taken from the CCTV footage and a control photograph of Biyela.

They found Biyela at the bus stop by pinging his phone after getting the number from the phone of his co-accused, Khumalo - the first to be taken in. Nziweni scoffed at Biyela's explanation for why he didn't bring his girlfriend to court in support of his alibi. "Mr Biyela was also not convincing when he was probed as to what type of Krugerrands he was dealing in. He could only describe the coins by saying old coins and by making a circle with his fingers," she said.
