The case came before Mr Justice Rory Mulcahy on Thursday

The ESB has said it cannot be compelled to continue employing one of its staff members alleged to have been involved in the corrupt payments scandal after the employee lodged a right to silence defence in the High Court.

On Thursday, Justice Rory Mulcahy heard arguments to determine whether technician Kieran Sharkey’s right to silence permits him to lawfully refuse to respond to the ESB’s questions on the alleged clandestine payments.
