A Federal High Court sitting in Abakaliki, Ebonyi State capital, has granted the request by the Peoples Democratic Party (PDP) to withdraw a suit it

instituted against Ebonyi State governor, Francis Nwifuru, challenging his nomination as governorship candidate of the All Progressives Congress for the 2023 general elections.

Earlier, the court presided over by Justice Fatun Riman struck out the case on February 14, 2023, on the ground that it was statute-barred following a notice of preliminary objection filed against the suit by the first and second defendants, Francis Nwifuru and the APC, respectively. Erhenede argued that hearing the notice of preliminary objection by the court without being served has denied the plaintiff a fair hearing, hence the motion before the court to set aside the said ruling.
