The New Jersey Supreme Court ruled a state trooper was unjustified when he searched a suspect’s vehicle after smelling marijuana.The highest appellate court in New Jersey ruled Thursday that a state trooper conducted an unauthorized search and seizure in 2016 when he searched a suspect’s vehicle after smelling marijuana.
Since the search was illegal, the evidence seized from it must be suppressed, the state Supreme Court ruled this week. “A generalized smell of raw marijuana does not justify a search of every compartment of an automobile,” Pierre-Louis wrote. Travis pulled over the vehicle and upon approach, noticed “a strong odor of raw marijuana” and observed “greenish-brown vegetation” on the driver’s beard, according to court testimony.
