But on Wednesday, the court of criminal appeals said the judge had “constitutional and statutory authority to preside” over the case when he moved it to Harris County.“We’re gratified but not surprised that the Court recognized that this defendant must stand trial before a Harris County jury and a judge who will follow the law,” said special prosecutor Brian Wice.
Wednesday’s decision could restart his long-stalled felony case on a similar timeline. A Collin County grand jury indicted Paxton on two counts of securities fraud and one count of failing to register with state securities regulators in 2015.
