The Supreme Court ruled for a 94-year-old woman who claimed Minnesota violated her constitutional rights by keeping a $25K surplus selling her home.

Ethics is the latest weapon against the Court's independence.

"The taxpayer must render unto Caesar what is Caesar's, but no more," Chief Justice John Roberts wrote in the court's opinion. "The Takings Clause 'was designed to bar Government from forcing some people alone to bear public burdens which, in all fairness and justice, should be borne by the public as a whole,'" the opinion stated.

"If a bank forecloses on a mortgaged property, state law entitles the homeowner to the surplus from the sale. And in collecting past due taxes on income or personal property, Minnesota protects the taxpayer’s right to surplus," the decision stated.

Speaking at a law dinner where he was honored with an award Tuesday, Roberts provided no specifics but said the justices “are continuing to look at the things we can do to give practical effect to that commitment.” He said he is “confident there are ways to do that.' The court has resisted adopting an ethics code of its own. But all nine justices recently signed a statement of ethics. Roberts' remarks suggested he knows that statement is not enough to quiet critics.
