The child's parents have sued the Northern Lehigh School District in federal court over the incident.

student have sued the school district and her first-grade teacher, claiming the teacher dug her nails into the child’s neck and left marks.

The lawsuit was filed Tuesday in federal court by two Slatington residents on behalf of their daughter.Peters Elementary SchoolIt says the teacher had trouble handling the girl’s behavior throughout that school year. The parents wanted their daughter moved to a different teacher but the district refused, the lawsuit says.Northern Lehigh School District Superintendent Matthew LinkThe lawsuit says the girl attended school online for two weeks after the incident.

The defendants are the Northern Lehigh School District, the superintendent, the elementary school principal and the teacher. The lawsuit was filed by attorneys Susan Ayres and Leonard Hill of Philadelphia. It’s unclear whether the parents pursued criminal charges against the teacher. Ayres and Hill didn’t respond to an email asking that question.

The five-count lawsuit seeks unspecified damages. It was assigned to U.S. District Judge Joseph F. Leeson Jr.
