Breaking: Daniel Penny will face second degree manslaughter charges and be arraigned Friday, the Manhattan DA's office says.

Neely will face a charge of manslaughter in the second degree.

The 24-year-old Marine veteran is expected to surrender to the Manhattan DA and is expected to be arraigned at Manhattan Criminal Court Friday. for nearly three minutes on May 1 after witnesses say Neely was behaving erratically on an F train.
