Presiding Judge James Omotosho, in a Wednesday ruling, said the NBC lacked the judicial powers to impose penalties.

“The action of the respondent qualifies as excessiveness” as it had ascribed to itself the judicial and executive powers.

However, the Incorporated Trustees of Media Rights Agenda had, in an originating motions marked: FHC/ABJ/CS/1386/2021, sued the NBC as sole respondent in the suit. The lawyer also said that the fines were in violation of the right to fair hearing under Section 36 of the 1999 Constitution and Articles 7 of the African Charter on Human and Peoples Rights Act Laws of the Federation of Nigeria, 2004.

They, therefore, sought an order setting aside the N500,000 fines purportedly imposed by the NBC on each of the 45 broadcast stations on Friday, March 1, 2019.
